California recently enacted changes in its laws governing the sale of structured settlement payments. Among other things, the new law recommends that those selling structured settlement payments secure independent professional advice to ascertain whether the transfer of their payments is in their best interest. If the structured settlements seller does not wish to secure such advice, he or she must expressly indicate that he or she is aware of the recommendation and decided not to secure additional advice. Courts will consder whether such independent professional advice was received in determining whether to allow a transfer of structured settlement payments. In addition, if no independent advice was purchased and no waiver was submitted to the court, the transfer will not be approved.
